End User License Agreement

This End User License Agreement sets the rules for every individual who signs in to a Dataflo product, including Billflo and Govflo.

Version 1.0 ยท Last updated October 21, 2026

Scope and acceptance

This End User License Agreement (“EULA”) sets the rules for every individual who signs in to a Dataflo product, including Billflo and Govflo. It is between you and Dataflo LLC (“Dataflo,” “we,” “us”).

You accept this EULA when you check the acceptance box at sign-up or first sign-in, or when you use a Dataflo product after it is presented to you. If you do not agree, do not use the product.

Users under a Customer contract. Your employer or organization (the “Customer”) may hold a subscription under our Terms of Service, an Order Form, or a purchase made through a cooperative contract, statewide price agreement or authorized reseller. In that case you use the product on the Customer’s behalf. The Customer’s contract governs the commercial relationship: fees, service levels, data ownership, liability and indemnity. This EULA governs how you, as an individual user, may use the product.

Free and self-serve users. If you sign up on your own with no Customer contract, this EULA is your full agreement with us for that account.

Order of precedence

If two documents conflict, the one higher in this list controls, but only to the extent of the conflict:

RankDocument
1Terms required by the governing procurement vehicle or by law applicable to a government Customer
2The Customer’s signed Order Form or contract with Dataflo
3Dataflo Terms of Service
4The product terms in Part B (Billflo) or Part C (Govflo) of this EULA
5The general terms in Part A of this EULA

Nothing in this EULA makes an individual government employee personally liable for the obligations of a government Customer, and nothing in it expands a government Customer’s obligations beyond what its contract and applicable law allow.

Part A: Terms for all Dataflo products

A1. Definitions

  • “Products” means Dataflo’s software-as-a-service products, including Billflo and Govflo, their web, mobile and API interfaces, and their documentation.
  • “Customer” means the organization that has a contract with Dataflo and authorized your account. A free or self-serve user with no Customer contract is their own Customer.
  • “Customer Data” means data, documents and records that you or the Customer submit to, connect to, or create in the Products, including AI Outputs.
  • “AI Features” means functions of the Products that use artificial intelligence or machine learning, such as summaries, transcription, answers to questions, classifications, scoring, drafted text and proposed redactions.
  • “AI Output” means content an AI Feature produces.
  • “Public Data” means legislative, governmental and other publicly available information that Dataflo collects from third-party and official sources.

A2. License

While your account is active and you follow this EULA, Dataflo grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Products. You may use them only for the Customer’s internal business or governmental purposes, within the scope the Customer purchased. Dataflo and its licensors keep all rights not expressly granted, including all rights in the Products, their software, models, design and Public Data compilations.

A3. Your account

  • Your sign-in is for you alone. Do not share credentials or let anyone else use your account.
  • Keep your credentials secure and use multi-factor authentication where the Product offers it.
  • Give accurate registration information and keep it current.
  • Tell us right away at the contact address in A16 if you suspect unauthorized access.
  • The Customer’s administrators may create, change, suspend or remove your account and may view activity and content in it.

A4. Acceptable use

You will not, and will not help anyone else:

  1. Copy, modify, reverse engineer, decompile or try to extract source code, model weights or prompts from the Products.
  2. Resell, sublicense, rent or provide the Products to anyone outside the Customer, or use them as a service bureau, except as Part B allows for professional-services Customers.
  3. Scrape, crawl, bulk download or systematically extract content, or use content or AI Output from the Products to train, fine-tune or evaluate any AI model, without Dataflo’s written consent.
  4. Use the Products to build or benchmark a competing product, or publish performance or benchmark results without Dataflo’s written consent.
  5. Probe, scan or test the security of the Products, or bypass access controls, usage limits or AI safeguards.
  6. Upload malware or content that is unlawful, infringing, defamatory, harassing or that violates anyone’s privacy.
  7. Use the Products in violation of law, including privacy, records, ethics, lobbying, campaign finance and procurement law.
  8. Remove proprietary notices, AI labels or disclosures that the Products display.

A5. Customer Data

As between you, the Customer and Dataflo, the Customer owns Customer Data. Dataflo uses Customer Data only to provide, secure, support and improve the Products for that Customer, as the Customer’s contract and our Privacy Policy allow, or as required by law. You confirm you have the right to submit the Customer Data you upload or connect. Dataflo may create and use aggregated, de-identified usage data that does not identify you, the Customer or any person.

A6. AI Features

  • Accuracy of AI Output. It is generated by probability, not judgment. It may be inaccurate, incomplete, outdated or biased, and it may sound confident when it is wrong.
  • Human review required. You must review AI Output before you rely on it, publish it or use it in an official communication, filing or decision. AI Output is never an official government statement, determination or record unless an authorized person adopts it through the Customer’s normal process.
  • No automated high-impact decisions. You will not use AI Output as the sole basis for a decision that has a legal or similarly significant effect on a person, such as withholding a public record, a benefits decision or an enforcement action.
  • No training on Customer Data. Dataflo does not use Customer Data, including your prompts and AI Output, to train generalized AI models without the Customer’s prior written consent.
  • Model providers. AI Features that process Customer Data run on third-party AI models hosted within Dataflo’s own cloud environment, in US regions only. Customer Data is not shared with model developers, and the hosting provider does not store it or use it to train any model. Billflo may also use third-party AI providers to process publicly available legislative data. No Customer Data is sent to these providers. Dataflo may change model providers without lowering these protections.
  • No professional advice. Dataflo is not a law firm, lobbying firm or accounting firm. Nothing in the Products is legal, compliance, tax or lobbying advice.

A7. Public Data and third-party services

Public Data comes from official and third-party sources that Dataflo does not control. Those sources can be late, wrong or unavailable. The official source controls over anything the Products display. If you connect a third-party service, your use of it is governed by that provider’s terms, and you authorize Dataflo to access it only as needed to deliver the feature you turned on.

A8. Privacy

Our Privacy Policy explains how we handle personal information about you as a user. Customer Data is handled under the Customer’s contract.

A9. Government users

  • You may disclose information about the Products when public records or open government law requires it. Where the law allows, please let us know first so we can identify any exempt material.
  • Any obligation to indemnify Dataflo applies only to free or self-serve users acting for themselves. It never applies to a government Customer or its employees beyond what the government Customer’s contract and applicable law allow.
  • Nothing in this EULA waives the sovereign immunity or tort claims protections of a government Customer.

A10. Feedback

If you send us ideas or suggestions, we may use them without obligation to you. Feedback never includes Customer Data.

A11. Suspension and termination

Your license ends when the Customer’s subscription ends, when the Customer removes your access, or when you close your account. Dataflo may suspend or end your access, with notice where practical, if you breach this EULA, if your use threatens the security or integrity of the Products, or if the law requires it. Retrieval of Customer Data after termination is handled under the Customer’s contract. Sections A4 through A16 survive termination.

A12. Disclaimers

EXCEPT AS THE CUSTOMER’S CONTRACT EXPRESSLY PROVIDES, THE PRODUCTS, AI OUTPUT AND PUBLIC DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE.” DATAFLO DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE PRODUCTS WILL BE UNINTERRUPTED OR ERROR-FREE.

A13. Limitation of liability

If you use the Products under a Customer contract, that contract’s limitation of liability is the only limit that applies, and you have no separate personal claim against Dataflo under this EULA. For free or self-serve accounts: TO THE MAXIMUM EXTENT THE LAW ALLOWS, DATAFLO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST DATA OR PROFITS, AND ITS TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DATAFLO IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS ($100). These limits do not apply where the law does not allow them.

A14. Mobile apps

This section applies when you download a Product app from the Apple App Store or Google Play.

  • This EULA is between you and Dataflo only, not Apple or Google. Dataflo alone is responsible for the app, its content, maintenance and support.
  • Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
  • Dataflo, not Apple, is responsible for any product liability, legal or regulatory compliance, consumer protection or privacy claims about the app, and for investigating and defending any claim that the app infringes a third party’s intellectual property.
  • You confirm that you are not located in a country subject to a US government embargo or designated as a terrorist-supporting country, and that you are not on any US government list of prohibited or restricted parties.
  • You must follow applicable third-party terms, such as your wireless carrier’s, when using the app.
  • Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you once you accept it.
  • If this EULA conflicts with the App Store’s usage rules, the App Store rules control for the app.

A15. Changes

We may update this EULA. We will post the new version with its effective date and, for material changes, notify you in the Product or by email and may ask you to accept again. For government Customers, changes do not alter the Customer’s contract during its current term without the Customer’s written agreement.

A16. Governing law and contact

This EULA is governed by New Mexico law, without regard to conflict of law rules. Disputes go to the state and federal courts in Bernalillo County, New Mexico, except that a government Customer’s own governing law and venue apply where the law requires.

Part B: Billflo product terms

These terms add to Part A when you use Billflo, the legislative intelligence product, on the web, on mobile or by alert.

B1. What Billflo is

Billflo is Dataflo’s legislative intelligence product, available on the web and on mobile apps.

B2. Legislative data and transcripts

  • Bill text, status, schedules, votes and video come from legislatures and other public sources. The official legislative record controls over anything Billflo shows.
  • Live transcripts are machine-generated during the hearing. They can mishear words, misattribute speakers and lag behind the room. They are not the official record.
  • Summaries, “arguments for and against,” fiscal figures pulled from bills and other analysis are AI Output under A6. They are informational and are not Dataflo’s position on any bill.
  • Before you quote, file or advise on anything from Billflo, check it against the cited bill or official source. Billflo links its answers to source bills so you can do this.

B3. Professional-services users

If the Customer is a lobbying, government relations, consulting or advocacy firm, you may use Billflo to prepare work product for the Customer’s own clients in the ordinary course. You may share your analysis, reports and exports with those clients. You may not give clients their own access to Billflo, share your credentials with them, or resell Billflo data, transcripts or alerts as a standalone feed.

B4. Regulatory compliance

You are responsible for your own compliance with lobbying registration and disclosure, ethics, gift, campaign finance and similar laws. Billflo is an information tool, not a compliance service.

B5. Alerts and SMS

  • If you opt in to text alerts, you agree to receive recurring automated messages about the bills, committees and keywords you follow. Message frequency varies with legislative activity. Message and data rates may apply.
  • Reply STOP to cancel and HELP for help. Consent to texts is not a condition of any purchase. See our SMS consent terms.
  • Alerts depend on upstream sources and carriers. A late or missed alert is not a breach of this EULA, so do not rely on alerts alone for a deadline.

B6. Free and self-serve accounts

Free accounts may carry limits on features, sessions, jurisdictions or history. Dataflo may change or end free features at any time. Free accounts receive no service-level commitment.

Part C: Govflo product terms

These terms add to Part A when you use Govflo, the public records and open meetings product. Sections C1 to C6 apply to agency staff. Section C7 applies to members of the public who submit requests.

C1. Records decisions

The Customer is the records custodian. Every decision to release, withhold, redact, deny, charge for or close a request is made by the Customer’s authorized staff, not by Govflo or Dataflo.

C2. AI-proposed redactions and drafts

  • Proposed redactions, exemption suggestions, responsive-record matches, precedent checks and drafted response letters are AI Output under A6.
  • Review each proposal before you act on it. Govflo can miss sensitive information or flag information that is not exempt.
  • You will not release records or send a response that Govflo prepared without a person reviewing it. You will not disable the review step or the record of who approved each action.

C3. Deadlines

Govflo calculates and displays statutory deadlines from the rules the Customer configures. Those calculations are aids, not legal determinations. The Customer remains responsible for meeting every deadline under the public records, open meetings and other laws that apply to it.

C4. Connected record systems

When the Customer connects a third-party system, Govflo searches and copies records only as needed to process requests. It does so within the permissions the Customer grants. You will connect only systems you are authorized to connect.

C5. Sensitive and regulated data

  • Criminal justice information. Govflo does not support data subject to the CJIS Security Policy. Do not use Govflo to process it.
  • Health information. Protected health information under HIPAA, and substance use disorder records under 42 CFR Part 2, may be processed only after the Customer and Dataflo sign a business associate agreement, including any qualified service organization terms that 42 CFR Part 2 requires.
  • Other regulated data. Do not use Govflo to process payment card data or student education records unless the Customer’s contract with Dataflo expressly covers that data type.

The Customer sets and applies its own records retention schedule and legal holds. Deleting content in Govflo removes it from user view. Backup copies are kept for no more than 30 days. The Customer should export anything it must keep before deleting it or before its subscription ends.

C7. Terms for requesters

These terms apply if you use a Govflo portal to submit a public records request or download records. The portal links to these terms where you submit a request, and submitting a request means you accept them.

  • Role of the agency. Your request goes to the government agency that runs the portal. Dataflo provides the software only and does not decide your request.
  • Public disclosure. Your request, your contact details and the agency’s response may themselves be public records. Do not include information you want kept private.
  • Questions about your request go to the agency. Questions about how the portal works go to the contact in A16.
  • Use rules. Sections A3, A4, A12, A13 and A16 apply to you. You may not submit requests in bulk by automated means or use the portal to harass agency staff.
  • Records you receive. Your rights to use released records come from public records law and the agency, not from Dataflo.
